How to Avoid a Court Summons When Recruiting Employees

Äripäeva podcast "Töö ja palk", Helen Roots · Jan 23, 2024

In the first episode of the year, the podcast “Töö ja palk” turns to employment law and focuses on making sure that all work-related activities stay within the boundaries of the law.

The podcast is available on Äripäev.

For this purpose, Helen Roots, Head of Personaliuudised, invited data protection officer Piia Laks-Järve, DataVie founder and recruitment software Recrur founder Marit Alaväli to the studio to discuss GDPR in the context of recruitment.

Although data protection law is no longer a new phenomenon, it remains highly relevant. There are still details that need to be explained, revisited, clarified and reminded. As an introduction, the discussion first explains what personal data means in the context of recruitment and which data must be protected during the hiring process.

The episode then explores the most common questions HR managers and recruitment managers have about personal data in recruitment. It also looks at the myths that have somehow started living a life of their own, as well as the most common mistakes made when processing personal data during recruitment.

The episode unpacks several hypothetical situations, from creating different lists based on collected data to accidentally sending those lists by email to the wrong person. The discussion also explains who is responsible if data are leaked, what to pay attention to when choosing a recruitment partner or recruitment software, when and what type of background checks may be carried out on candidates, when and what kind of consent should be requested, and how AI fits into all of this.

The episode concludes with an important principle: although fines for legal violations vary widely and may reach into the millions, a company’s reputation is also at stake, and reputational damage cannot be repaired with money.
